Terms & Conditions
1. Definitions

“Company” refers to Validus Construction.

“Client” means the individual or organisation requesting services from the Company.

“Services” refer to any construction, landscaping, groundworks, repair, or associated services provided by the Company.

“Contract” means the agreement between the Company and the Client for the provision of Services.
2. Estimates and Quotations
-
All estimates and quotations are valid for 30 days unless otherwise stated.

Estimates are subject to site inspection and may change based on unforeseen conditions or variations requested by the Client.

Any additional work not included in the original quotation will be charged accordingly and must be agreed upon in writing.
3. Acceptance of Work
-
A contract is formed when the Client accepts a written quotation or when work commences with the Client’s approval.

By accepting the quote, the Client agrees to be bound by these terms and conditions.
4. Payment Terms
-
A deposit may be required before work commences.

Invoices are due within 14 days of the invoice date unless otherwise agreed in writing.

Late payments may incur interest and/or administrative charges in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.

The Company reserves the right to suspend work if payments are not made as agreed.
5. Client Responsibilities

The Client shall provide access to the site and utilities as required to carry out the work.

The Client is responsible for obtaining any necessary permissions, approvals, or consents (e.g., planning permission, listed building consent) unless otherwise agreed.
6. Completion and Delays
-
The Company will use reasonable efforts to complete work within the agreed timeframe but shall not be held liable for delays caused by weather, unforeseen circumstances, third parties, or supply issues.

Any delay caused by the Client may result in additional charges.
7. Variations and Changes
-
Any changes to the original scope of work must be agreed in writing and may affect the cost and duration of the project.
8. Materials and Workmanship

All materials supplied will be of suitable quality and fit for purpose.

The Company guarantees its workmanship for 12 months unless otherwise specified.

Manufacturer warranties on materials will be passed to the Client where applicable.
9. Liability
-
The Company holds appropriate public liability insurance.

The Company is not responsible for any loss, damage, or delay caused by circumstances beyond its control.

The Company shall not be liable for any consequential or indirect loss.
10. Termination
-
Either party may terminate the contract in writing if the other commits a material breach.

The Client may be liable for costs incurred to date in the event of cancellation.
11. Waste and Site Clean-Up
-
The Company will remove construction waste where included in the quote. Additional disposal costs may apply for items not agreed upon in advance.
12. Dispute Resolution
-
The Company aims to resolve disputes amicably. If a resolution cannot be reached, both parties agree to seek mediation before pursuing legal action.
13. Governing Law
-
These terms shall be governed by and construed in accordance with the laws of England and Wales.
